These Terms of Service govern services provided by RGB Custom Builders (“RGB,” “we,” “us,” or “our”) to clients (“you” or “your”).
By engaging RGB for services, approving a proposal or estimate, signing a construction agreement, making a deposit or payment, or otherwise authorizing work to begin, you agree to these Terms of Service.
1. Our Services
RGB Custom Builders provides custom home design, construction, and related building services in the Pocono Mountains region and surrounding areas, including quick-delivery homes, house plans, and build-on-your-lot services.
Specific scope, pricing, specifications, and timelines will be outlined in a proposal, estimate, construction agreement, or other written agreement between RGB and the client.
If there is a conflict between these Terms and a specific written agreement, the specific written agreement will control.
2. Client Responsibilities
You agree to provide RGB with the information, approvals, site access, and decisions reasonably necessary to perform construction services, including homesite information, financing/pre-approval status, selections, and timely approvals.
Delays in receiving required approvals, selections, financing documentation, or site access may affect project timelines.
3. Construction Timelines
Construction timelines are estimates rather than guaranteed completion dates. Weather, permitting, material availability, subcontractor scheduling, inspections, and client-requested changes may affect the build schedule.
4. Changes and Selections
Services are performed according to the agreed scope of work and selections. Change orders outside the agreed scope may be billed separately and may affect the project timeline. RGB will generally communicate with you before performing additional work that results in additional charges.
5. Payments
Payments are due according to the schedule stated in the applicable construction agreement or invoice. Late payments may result in suspension of work until balances are resolved. Deposits and progress payments are generally non-refundable once the corresponding work has been performed.
6. Warranties
RGB provides warranty coverage as described in the applicable construction agreement and any manufacturer or trade warranties that apply to specific materials or systems. These Terms do not expand or limit warranty coverage described in a separate written warranty document.
7. Third-Party Services and Materials
RGB may use subcontractors, suppliers, and other third parties as part of a project. RGB is not responsible for delays, defects, or failures caused by third-party suppliers, manufacturers, or service providers outside RGB’s reasonable control, except as otherwise provided in a specific written agreement.
8. SMS/Text Messaging Terms
By opting in through our website or verbally, you agree to receive text messages from RGB Custom Builders related to your inquiry, consultation scheduling, project updates, and occasional promotional offers, at a frequency of up to 4 messages per month. Message and data rates may apply. Reply HELP for help. Reply STOP to cancel at any time. For more information on how we handle your data, see our Privacy Policy. Carriers are not liable for delayed or undelivered messages.
9. No Professional or Legal Advice
RGB provides construction and related services and does not provide legal, accounting, tax, financial, or other professional advice outside the scope of its services. Clients are responsible for obtaining appropriate professional advice when required.
10. Limitation of Liability
To the fullest extent permitted by law, RGB will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the services. RGB’s total liability for a particular project will not exceed the amount actually paid to RGB for that project.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
11. Force Majeure
RGB will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, weather, material shortages, labor disruptions, permitting delays, or other events that could not reasonably have been prevented.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute will be handled in a court of competent jurisdiction located in Pennsylvania unless the parties agree otherwise in writing.
13. Changes to These Terms
RGB may update these Terms of Service from time to time. The version in effect when services are provided will apply, except where a separate written agreement establishes different terms. Material changes will be posted on this website with an updated effective date.
14. Entire Agreement
These Terms, together with any applicable proposal, estimate, construction agreement, or other written agreement between RGB and the client, constitute the agreement governing the applicable services.
